<p>If  you&#8217;ve  ever  purchased  a  CD  or  at  least  been  to  a  record  store  and  looked  around,  you&#8217;d  be  intimate  with  the  Recording  Industry  Association  of  America  (RIAA)  logo  that&#8217;s  on  some  of  the  record  album  covers  that  says:  Parental  Advisory  &#8211;  Explicit  Content.  The  recording  company  that  devised  the  album  decides  which  ones  get  the  sticker  and  which  ones  don&#8217;t,  so  it  isn&#8217;t  precisely  a  rating  given  out  by  a good deal of  accredited  evaluation  group.  There  isn&#8217;t  a  usual  set  of  criteria  to  tick  off  against,  but  the  albums  that  have  this  warning  are  ordinarily  presumed  to  have  instances  of  strong  profanity,  violence  and/or  sexual  situations.  Critics  have  said  that  an  album  that  has  a  sticker  doesn&#8217;t  inevitably  mean  that  it&#8217;s  more  profane  than  one  that  doesn&#8217;t  have  a  sticker.  Some  have  been  primary  freed  without  the  label  and  subsequently  re-released  with  one.  In  other  words,  the  label  isn&#8217;t  as  telling  as  album  titles  like  &#8220;Prolonging  the  Magic&#8221;  and  &#8220;Barely  Legal.&#8221;</p>
<p>The  label  was  primarily  made  to  warn  parents  versus  musical  content  that  may  allegedly  affect  their  kids  undesirably.  Its  advocates  and  members  of  the  recording  industry  were  armed  with  selective information  that  showed  a  link  amidst  violent  and  aggressive  lyrics  and  the  incidence  of  violence  in  their  listeners.  Some  of  the  musicians  who  pushed  the  envelope  for  these  particular  interest  groups  included  the  likes  of  Eminem,  who  sang  in regards to  guns  and  kids  who  use  them,  and  Marilyn  Manson,  who  has  used  American  flags  as  toilet  paper  in  his  concert  acts.</p>
<p>Although  the  problem  is  real  and  the  link  may  be  substantial,  the  parental  advisory  label  may  not  be  serving  it is  purpose.  Critics  have  likewise  forwarded  the  theory  that  youngsters  may  find  that  the  label  makes  the  album  more  enticing,  and  they&#8217;ll  buy  it,  anyway.  And  this  could  be  the  reason  why  recording  companies  aren&#8217;t  as  discriminating  as  they&#8217;re  expected  to  be  in  settling  which  records  get  parental  advisory  labels.  In  essence,  the  advocates  may  have  to  find  a  better  way  to  regulate  the  distribution  of  records  and  to  warn  the  parents  of  what&#8217;s  out  there  for  kids.  On  the  other  hand,  the  counterargument  always  is  that  there  may  be  other  components  that  lead  to  these  not wanted  aftermaths  that  they&#8217;re  avoiding.  Parents  may  think  when it comes to  talking about  these  issues  with  kids  openly,  so  they  may  be  challenged  to  think  beyond  what  they  see  and  hear.  They  ought to  learn  to  receive  that  music  isn&#8217;t  always  the  commodious  scapegoat.</p>

<p>You  have  found  a  established  publisher  for  your    book,  and  it&#8217;s  time  to  negotiate  the  contract!  Don&#8217;t  let  the  excitement  cause  you  to  ignore  the  details  involved  in  what  is  undoubtedly  the  single  most  essential  dealing  that  will  take  place  in  the  life  of  your  book.</p>
<p>Even  if  you  have  an  agent,  <i>you</i>  need  to  understand  the  issues,  so  that  you  recognise  what  you  are  agreeing  to  when  you  sign  on  the  dotted  line.  Otherwise,  you  may  find  out  too  late  that  there  are  unexpected  or  unfair  aftermaths  which  you  did  not  foresee.</p>
<p>Each  book  publisher  has  a  frequent  publishing  contract.    The  extent  of  the  modifications  you  may  negotiate  will  depend  upon  how  eager  the  publisher  is  to  sign  you  up.  Unless  you  are  a  big-name  author,  more spectacular  publishers  may  concede  you  only  fixed  changes.  Smaller  publishers  may  be  more  more than willing  to  work  with  you.  If  the  publisher  will  not  make  a  alter  you  request  in  the  contract,  you  will have to  determine  if  you  may  live  with  it  as  it  is,  or  whether  the  refusal  to  make  the  modify  is  a  &#8220;deal  breaker&#8221;  that  will  cause  you  to  walk  away  from  the  agreement.</p>
<p>1.  	GRANT  OF  RIGHTS</p>
<p>The  Grant  of  Rights  provision  of  the  contract  addresses  the  specific  rights  you  are  granting  the  publisher.  Be  leery  of  transferring  &#8220;all  rights&#8221;  for  the  term  of  the  copyright.  The  term  of  the  copyright,  for  works  formulated  after  1977,  is  the  author&#8217;s  lifetime,  plus  70  years,  after  which  the  work  goes  into  the  public  domain,  meaning  it  no  longer  has  copyright  protection.    Instead,  think  when it comes to  restricting  the  rights,  important  and  secondary,  that  you  are  transferring  to  the  basi  publisher,  and  likewise  to  limiting  the  geographical  scope,  and  language  markets  covered  by  the  contract.</p>
<p>Primary  book  publishing  rights  are  hardcover,  trade  paperback,  mass  marketing,  and  direct  mail.  The  contract  ought to  specify  incisively  which  of  these  rights  you  are  transferring.  In  <i>Dolch  v.  Garrard  Publishing  Company</i>,  a  court  case  decisive  in  1968,  Marguerite  and  Edward  Dolch,  writers  of  children&#8217;s  books  marketed  in  hardcover  bindings  to  schools  and  libraries  beginning  in  regarding  1950,  had  transposed  &#8220;the  exclusive  right  of  publication  of  the  books&#8221;  to  the  publisher.  In  1963,  with  the  new  popularity  of  paperbacks,  Mrs.  Dolch,  her  husband  by  then  deceased,  wished  to  sign  a  contract  with  Dell  Publishing  Company  to  reprint  galore  of  the  books  in  paperback.  Although  Mr.  and  Mrs.  Dolch  had  apparently  never  thought  with regards to  paperback  publication  when  they  entered  into  the  contracts  at  issue,  the  court  found  that  Garrard  Publishing  Company  held  the  rights  to  paperback  publication  because  the  term  &#8220;the  books&#8221;  meant  both  hardcover  and  paperback  The  lesson  from  <i>Dolch</i>  is  to  beware  of  vague  language  in  contracts.</p>
<p>Secondary  rights  include  periodical  rights,  introductory  serial  rights,  book  club  rights,  dramatic  rights,  motion  picture  rights,  television  rights,  radio  rights,  animation,  marketing  or  mercantile  tie  in  rights,  electronic  rights,  and  video-  and  audiocassette  rights.    You  will have to  limit  the  secondary  rights  you  grant  to  those  the  publisher  may  adequately  exploit.  Book  club  rights  commonly  go  to  the  hardcover  book  publisher,  but  an  author  normally  does  not  concede  secondary  rights  such  as  dramatic  rights,  motion  picture,  and  television  rights  to  a  book  publisher.  Authors  will have to  retain  these  rights  in  order  to  contract  for  them  independently.  Secondary  licensing  and  sub-licensing  issues  are  beyond  the  scope  of  this  article.<br />
<br />Other  limitations  may  specify  a  geographical  and  language  area.  It  is  not  not common  for  a  publisher  to  ask  for  &#8220;first  exclusive  North  American  book  rights.&#8221;    The  British  Commonwealth  is  the  next  most  worthful  English  language  market.  Western  Europe  and  Japan  are  major  alien  markets.  Publishers  for  these  other  markets  will  come  calling  if  your  book  is  a  success  in  North  America.</p>
<p>What  when it comes to  new  technology?    Terms  such  as  &#8220;book  form&#8221;  and  &#8220;electronic  rights&#8221;  will have to  be  conservatively  specified  in  the  contract.  Just  a  few  years  ago,  everyone  supposedly  understood  terms  like  &#8220;publish&#8221;  and  &#8220;all  rights,&#8221;  but  that  is  no  longer  true.  The  failure  of  older  publishing  agreements  to  contemplate  electronic  rights  has  resulted  in  a  substantial  amount  of  litigation.  As  not so long ago  as  2002,  Random  House  and  electronic-book  publisher  Rosetta  Books  were  litigating  the  issue  of  whether  Random  House&#8217;s  contracts  with  it is  writers  to  altogether  &#8220;print,  publish  and  trade  the  work  in  book  form&#8221;    included  an  implied  right  to  publish  and  trade  the  eBook  version.    Random  House  sued  for  copyright  infringement  and  interference  with  contracts  after  Rosetta  contracted  directly  with  sure  Random  House  writers  to  publish  the  electronic  version  of  their  books.    After  the  federal  appellate  court  upheld  the  district  court&#8217;s  denial  of  Random  House&#8217;s  motion  for  a  preliminary  injunction  to  stop  Rosetta  from  publishing  and  selling  the  eBook  versions  while  the  litigation  continued,  Random  House  apparently  saw  the  handwriting  on  the  wall,  and  the  two  publihing  houses  reached  a  settlement  that  permitted  Rosetta  to  license  and  publish  51  titles  kept  by  Random  House.    Today,  publishers  are  conscious  of  the  need  to  include  rights  to  new  engineering science  in  their  publishing  agreements,  and  you  may  suppose  their  frequent  contracts  to  be  as  wide  and  far  reaching  as  possible.</p>
<p>The  bundle  of  rights  that  come  into  being  when  a  manuscript  is  formulated  are  priceless  sum totals  if  you  become  a  best-selling  author.    You  ought to  be  concerned  with regards to  who  has  the  right  to  capitalize  on  them,  and  for  how  long.  Under  present  copyright  law,  rights  you  do  not  expressly  concede  to  the  publisher  will  be  kept  by  you.  However,  if  the  language  in  the  contract  is  vague,  you  could  end  up  arguing  in regards to  it is  meaning  in  a  court  of  law,  and  you  may  not  have  the  bank  account,  or  the  stomach,  to  litigate. It  is  up  to  you  to  limit  what  you  are  merchandising  or  licensing  to  the  reasonable  value  of  the  payment  you  are  receiving.</p>
<p>2.  	DELIVERY  OF  MANUSCRIPT</p>
<p>The  contract  will have to  specify  when  you  must  deliver  the  manuscript,  and  supporting  materials,  to  the  publisher  and  in  what  format.  The  work  must  be  identified  by  a  working  title  or,  if  the  title  is  not  yet  decisive  upon,  adequately  described,  along  with  it is  agreed-upon  length  and  scope.  If  the  book  will  have  supporting  materials  in  which  you  will  hold  the  copyright,  such  as  indexes,  drawings,  charts,  maps,  graphs,  tables,  and  photographs,  the  contract  must  specify  whether  you  or  the  publisher  are  responsible  for  preparing  these.    If  you  will  be  using  supporting  materials  or  long  quotes  or  reprinted  materials  in  which  third  parties  hold  the  copyright,  the  contract  ought to  say  who  is  responsible  for  obtaining  these  rights,  what  rights  are  required,  and  who  pay  for  them.</p>
<p>If  you  are  writing  on  a  peculiarly  &#8220;hot&#8221;  topic,  the  contract  may  state,  &#8220;Time  is  of  the  essence.&#8221;  Do  you  know  what  this  means? The  rejection  of  a  manuscript  as  highly inadequate  has  resulted  in  major  litigation.  Pay  attention  to  whether  the  contract  provides  that  the  manuscript  will have to  be  satisfactory  in  form  and  content,  or  whether  the  publisher  may  reject  the  work  based  on  it is  sole  discretion  or  judgment.      &#8220;Form&#8221;  refers  to  how  the  respective  elements  of  a  piece  of  writing  are  composed  or  put  together,  and  &#8220;content&#8221;  is,  of  course,  the  substantive  or  significant  share  of  the  work.  A  deficiency  in  form  and  content  is  one  that  the  author  may  have  some  power  to  remedy.</p>
<p>A  number  of  well-known  legal  cases,  including  one  in  1982,  arising  out  of  Harcourt  Brace  Jovanovich&#8217;s  rejection  of  a  manuscript  by  the  late  Senator  Barry  Goldwater,  indicate  that  there  is  an  implied  obligation  for  the  publisher  to  provide  editing  assistance,  if  necessary  for  the  author  to  carry out  the  contract  satisfactorily.    Harcourt  failed  to  provide  editorial  assistance  to  Goldwater  and  his  ghostwriter  even  altho  they  requested  it.      Goldwater&#8217;s  book,  <i>With  No  Apologies</i>,  became  a  best  vender  when  subsequently  published  by  William  Morrow  &amp;  Company,  and  Harcourt  sued  to  get  it is  $65,000  advance  back. Here,  the  court  said  the  publisher  had  acted  in  good  faith  because  the  actor  had  refused  &#8220;renderings  of  assistance&#8221;  for  a  manuscript  which  one  editor  at  Doubleday  called  &#8220;junk,  pure  and  simple.&#8221;  Doubleday  won  a  judgment  versus  Curtis  for  the  $50,000  advance  it  had  paid.  The  novel  was  never  published.</p>
<p>To  be  safe,  ask  the  publisher  to  agree  (1)  not  to  cancel  the  contract  except  for  good  cause,  and  (2)  to  provide  you  with  editorial  assistance  and  an  chance  to  remedy  any  deficient  performance  before  a  determination  of  dissatisfaction  is  made.  What  constitutes  &#8220;good  cause&#8221;  varies  from  case  to  case,  depending  upon  the  facts. <p>5.	AUTHOR&#8217;S  REPRESENTATIONS  AND  WARRANTIES</p>
<p>You  will  be  required  to  make  sure  representations  and  warranties  with  regard  to  your  book,  such  as:</p>
<p>*You  are  the  sole  creator  and  proprietor  of  the  material  you  deliver  to  the  publisher;</p>

<p>*The  work  does  not  infringe  any  statutory  or  mutual  law  copyright;</p>
<p>*The  work  does  not  violate  any  right  of  privacy,  and</p>
<p>*The  work  is  not  libelous  or  obscene.</p>
<p>If  your  book  includes  recipes,  or  formulas,  you  may  likewise  suppose  to  be  required  to  represent  and  warrant  that  they  are  correct,  and  not  injurious  to  the  user.  The  warranties  you  give  the  publisher  will have to  not  extend  to  materials  included  in  the  book  that  you  did  not  provide.</p>

Holland<br />The answer to that question is why most readers will bother buying, borrowing or reading this book by the former Massachusetts Governor and 2008 Presidential primary candidate. In this time of national and international recession the voters and affected non-voters around the world are looking for a leader who can actually solve the major emergencies facing America, Freedom and Capitalism itself. <br />	As the grandson of American Immigrants whose family was run out of Mexico by Mexican revolutionaries angry with American Expatriates, Mitt grew up as part of a family that worked themselves up from desperate poverty to live the American Dream. His father worked as a wall plasterer while he supported his family and worked his way through college. He eventually earned his way into the presidency of American Motor Corporation (AMC) and bet his house (or at least the money he&#8217;d made from selling his home) on the successful development of the Rambler compact car. He later became three-time governor of Michigan. <br />	Mitt grew up in a family that had strong core values and he discusses those core values throughout this book. This reviewer actually met most of Mitt&#8217;s family including Gov. George Romney when Mitt ran an unsuccessful campaign for Senate in Massachusetts. The whole family was part of that campaign and the lessons they learned with that loss served Mitt well a few years when he successfully won election for the Governorship of the Commonwealth of Massachusetts. Romney managed to do a good job managing that state even though he didn&#8217;t have enough Republican legislative votes to uphold a veto and therefore had to reach across the aisle to the Democrats controlling the State House in order to accomplish his agenda.<br />	Romney believes that if America becomes a victim of socialism that freedom throughout the world will be lost.  If the nation is not careful, it will become a second rate world country&#8211;still strong enough to survive, but not strong enough to defend freedom anywhere else in the world. <br />	&#8220;There are three pillars that sustain a free and strong America:<br />		l. A Strong Economy<br />		2. A Strong Military<br />		3. A free and Strong People.&#8221;<br />	Romney then provides an agenda for a free and strong America. His list of goals includes 64 separate items and even Romney admits that his is not a complete list of changes needed. Studying that agenda will provide the reader with a decent idea of how Romney would tackle the nation&#8217;s problems.<br />	The book&#8217;s second chapter &#8220;Why Nations Decline&#8221; is also instructive. Mitt briefly examines the reasons the Ottomans, the Spanish, the Portuguese, the Chinese, the British, the Soviets&#8211;these were all super-powers of their respective eras &#8220;and they were all surpassed.&#8221; The reasons for these nation&#8217;s failures were eerily similar to much of what is occurring in the USA and Western Europe. <br />	The book examines many of the reasons for today&#8217;s problems and provides some pretty decent ideas about how to solve them. Romney also describes why many people prefer to live in denial of the facts and why in past civilizations that failure to face undeniable facts led to the destruction of those great civilizations.<br />	In the book&#8217;s eleventh and last chapter this reader was surprised by some personal <br />stories that brought tears to my eyes. Since I was reading while seated at the Prudential Center Food Court Terrace, it was a little embarrassing to suddenly finding my eyes tearing up and salty streams trickling down my cheeks. That anything in this volume might require having tissues available was a total shock. Surprise, surprise, because the previous 99% of the book had been straight-forward logic and business-like explanations of Romney&#8217;s beliefs and ideas on how to solve the nation&#8217;s rapidly expanding and very dangerous problems, this ability to bring forth tears in an audience was enlightening. <br />The text was not boring and there was a little humor such as Mitt&#8217;s description of the fall his wife Ann experienced when the stage they were speaking from in Dubuque, Iowa, collapsed. When she got up, &#8220;dusted herself off, and later ad-libbed, `Well, I fell on de butt in Dubuque.&#8217;&#8221; The man obvious isn&#8217;t just a cool headed, unflappable, maybe sometimes seemingly unfeeling man; he is an experienced leader and well schooled in the workings of Capitalism, industrial production and job producing economics He is also amazingly well spoken and as Bostonians know, he used to sometimes substitute as a host on a popular conservative talk show in order to keep in touch with the Massachusetts public. He wasn&#8217;t afraid to talk to the general public, but he relished the opportunity that only talk radio provides for contact with typical voters. He loved that form of give and take communication.<br />	This is a good read for this political genre. It will provide the information that many people will need to decide if years of leadership experience should triumph over hope.</p>

He wants America to be safe and active with a vigorous free market. He discusses national security, economic productivity, education and energy among other things.</p>
<p>Romney does use lots of data to back up his opinions. That&#8217;s actually a good thing, though some people might be turned off by it.</p>
<p>Romney tells us, &#8220;This is a book about what I believe should be our primary national objective: to keep America strong and to preserve its place as the world&#8217;s leading nation. And it describes the course I believe we must take to strengthen the nation in order to remain prosperous, secure, and free.&#8221;</p>
<p>But we also learn about Romney, the man.</p>
<p>He is the son of a third generation American Immigrant whose family was run out of Mexico by Mexican revolutionaries. He grew up as part of a family that worked itself up from horrible poverty to live what most consider the American Dream. </p>
<p>His father worked as a wall plasterer while he supported his family and worked his way through college. Mitt&#8217;s father became president of American Motor Corporation (AMC) and later became three-time governor of Michigan.</p>
<p>Romney discusses the values he grew up with. Of course, he went into politics like his father before him. He tells us in his book that if America turns to socialism, freedom throughout the world will be lost. If we are not careful with what we have left, we&#8217;ll become a second-rate country.</p>
<p>I found the book enlightening and hopeful. I think you will too.</p>

Merrill<br />Considering the title No Apology, you might think this book is possibly just an attack ad on President Obama&#8217;s &#8220;apology tour.&#8221;  To the contrary, No Apology is an expression of optimism, alongside the positive premise that we need to do more to pass America on to our kids and grand kids a free and strong nation.</p>
<p>No Apology is equally divided between foreign policy and domestic agenda concerns.  If you watched Mitt&#8217;s appearance on The View, you know his top three concerns (aside from replacing the President, the Senate, and Congress!) are protecting the threatened American dream (including managing debt), making Medicare sustainable, and reforming education (hiring from the top third of our schools and paying higher starting salaries to this higher standard of teachers!)  These concerns along with some specific prescriptions and creative ideas are major themes of his book.</p>
<p>Ultimately, this book is Mitt&#8217;s humble and inspiring attempt to contribute to the conversation of what America should be.  It&#8217;s not about election or reelection, but doing what is right for our kids and grandkids, the real America.</p>
<p>If you&#8217;re not sure what to think of Mitt, be sure to take your Amazon copy of No Apology to one of the stops on his book tour!  This book is authentic Mitt, and those who understand the real problems America is facing would be crazy not to consider him for our next President.</p>
